Protecting Property Owners
Landlords have several rights under New Jersey law, including the right to increase rent upon renewal of a lease where not prohibited by a local municipality. Nonetheless, New Jersey is one of the most pro-tenant states in the country.
The Anti-Eviction Act, the Landlord Registration Act, and the Security Deposit Act are just a few of the laws landlords must comply with. Violations can carry fines of thousands of dollars. An improperly drafted lease that omits required statutory language may even be subject to nullification — eliminating a landlord's ability to recover attorneys' fees from a defaulting tenant.
Protecting Tenants
In exchange for timely rent payments, tenants have a legal right to safe and habitable housing. Landlords may not wrongfully enter a tenant's premises through any active or passive efforts that interfere with the tenant's right to quiet enjoyment of the property.
Tenants have specific rights regarding eviction — particularly around proper Notice. Landlords may not change locks or cut off utilities simply because an eviction has been filed. Tenants may also withhold rent if there is a hazardous condition, a health issue, or a critical repair the landlord has failed to complete. In many disputes where tenants prevail, attorney fees must be paid by the landlord.
